Affiliate Program Terms and Conditions

To participate in the Affiliate Program, you need to create an account with us and submit a completed application.

A valid PayPal account, bank account, or any acceptable payment method is required to handle payment disbursements.

By applying for the Affiliate Program, you confirm that you are at least 18 years old.

Additionally, you must not reside in any country currently subject to sanctions imposed by the Office of Foreign Assets Control, as this status may change at any time.

After you submit your online application, Beauty AI will review it and may, at its sole discretion, accept you as an Affiliate based on alignment with our brand values and demographic considerations, which will be continuously assessed.

If you are selected, you will receive an approval notification via email from our third-party service providers.

Once approved, you will have access to your account and will be provided with a unique URL (“Unique URL”) to promote on your website and social media platforms as outlined in this Agreement.

Beauty AI reserves the right to periodically reassess your Affiliate status and may terminate your participation in the program at any time, with termination becoming effective immediately upon notification.

Eligible Products for which you can earn a commission include our Beauty AI Subscription Plan and Pay-as-you-go Plan. These products can be purchased through either a monthly subscription or a one-time payment. Please be aware that custom-priced packages that are not available for self-service do not qualify as eligible products.

We use third-party service providers to track customer engagement from the moment someone clicks your Unique URL to their purchase of an Eligible Product on the Beauty AI website.

You will earn a commission of basic 20%, up to 40% for each Valid Purchase of an Eligible Product made by a New Beauty AI Customer for one year. A "New Beauty AI Customer" is defined as someone who has never subscribed to or paid for any Beauty AI products (regardless of eligibility) before.

A "Valid Purchase" refers to a purchase made by a New Beauty AI Customer who clicked on your Unique URL and obtained an Eligible Product from the Beauty AI website. We reserve the right to determine whether a purchase qualifies as a Valid Purchase and maintain the authority to resolve any tracking discrepancies.

You acknowledge that we retain all rights to the tracking data generated through your participation in this Affiliate Program, as monitored by third-party service providers.

You will earn a commission when a Referral makes a Valid Purchase as defined in this Agreement. A “Referral” refers to a New Beauty AI Customer who completes a Valid Purchase.

Affiliates earn a standard commission rate of basic 20%, up to 40% on the subscription sale price of Eligible Products for a maximum duration of 12 consecutive months from the initial sale. Please note that commissions are not provided on renewal terms. For monthly subscriptions, you can earn a commission on consecutive monthly renewals for up to 12 months. If the Referral cancels their subscription before the 12-month period concludes, no further commissions will be issued.

Beauty AI reserves the right to modify commission percentages with written notice, which will take effect immediately for any Referrals after the notice date. High-performing Affiliates may qualify for increased commission rates at the discretion of Beauty AI.

Commissions are typically paid on the 15th of the month for Valid Purchases made in the previous month. You must have a PayPal account or provide bank details for payment processing, and you agree to supply the necessary information to Beauty AI.

Deductions: Commissions will exclude taxes, VAT, transaction fees, and related costs. Beauty AI retains the right to reverse commissions due to returns, cancellations, or incorrect payments. Additionally, commissions may be delayed or denied for disputed orders or if the Affiliate breaches this Agreement.

Beauty AI reserves the right to reject affiliate applications for any reason and may choose whether to provide an explanation for the rejection. Below are examples of potential reasons for application rejection (this is not an exhaustive list):

To maintain the integrity of Beauty AI and ensure a positive experience for everyone involved, the following promotional methods are strictly prohibited:

Beauty AI may provide you with promotional materials, including graphic banners, Beauty AI marks, logos, and other content for use on your website or social media platforms (“Licensed Materials”). We grant you a limited license to utilize these Licensed Materials in accordance with this Agreement and any brand guidelines we may provide.

The Beauty AI Eligible Products, as well as the Licensed Materials—including Beauty AI marks, domain names, and promotional assets—constitute our intellectual property and encompass various forms of protection such as trademarks, copyrights, patents, and trade secrets.

As an Affiliate, you recognize that we hold ownership of all customer-related information, including that which is generated through Referrals. It is essential that you respect our intellectual property rights at all times and adhere fully to the stipulations outlined in this Agreement.

As an Affiliate, you confirm your commitment to comply with all applicable U.S. and international laws, rules, and regulations. This includes, but is not limited to, regulations governing marketing communications such as the CAN-SPAM Act, the Telemarketing Sales Rule, and the Telephone Consumer Protection Act.

You are also required to adhere to guidelines set forth by the FTC regarding marketing practices, endorsements, and the disclosure of material relationships. Additionally, compliance with anti-spam laws, privacy regulations (including the California Consumer Privacy Act and the General Data Protection Regulation), as well as laws against false or misleading advertising and intellectual property regulations, is essential.

When promoting on third-party social media platforms, such as Facebook or Instagram, it is essential to comply with all applicable policies, terms of service, community standards, and values of those platforms.

If you are marketing or operating as an Affiliate outside the U.S., you are fully responsible for ensuring compliance with all local laws related to marketing and privacy. If you are uncertain about the relevant regulations that apply to you, it’s advisable to consult with a legal professional or your local consumer protection authority for comprehensive guidance on compliant Affiliate practices.

Beauty AI reserves the right to change, modify, or eliminate the Affiliate Program and any portion of this Agreement or related policies at any time and for any reason at our discretion. This includes the ability to alter or discontinue benefits or commissions associated with the Affiliate Program or merge it with another program. Any updated terms will be posted on our website or communicated to you via email. Your continued participation in the Affiliate Program signifies your acceptance of these updated terms.

We also reserve the right to suspend or remove Affiliates from the Beauty AI Affiliate Program at any time, without prior notice, and at our sole discretion. Either party may terminate this Agreement for any reason, with or without cause, by notifying the other party. Upon termination, you agree to immediately cease using your Unique URL and all links to Beauty AI websites, as well as any Beauty AI Licensed Materials, including our marks. Additionally, Affiliates terminated for malicious or fraudulent behavior will forfeit any previously earned commissions, without limiting our other available remedies.

You acknowledge that you are an independent contractor, and nothing in this Agreement establishes a partnership, joint venture, agency, franchise, sales representative, or employment relationship between you and Beauty AI. You do not have the authority to make or accept offers or representations on our behalf. Additionally, you agree not to make statements, whether on your website or elsewhere, that could contradict this section.

You may be required to complete a Form W-9 or other paperwork as a condition for receiving your commissions, and you agree to cooperate with any requests from Beauty AI to complete the necessary documentation related to your participation in the Affiliate Program. You also commit to complying with all applicable tax obligations.

By agreeing to this Agreement, you consent to resolve any disputes with Beauty AI through binding arbitration, thereby waiving your right to a jury trial or participation in class-action proceedings. Before initiating arbitration, you must provide written notice of the dispute to Beauty AI and attempt to resolve the matter informally within a 60-day period. If the issue remains unresolved after this timeframe, arbitration may commence.

Arbitration will be conducted by a single arbitrator under either the JAMS International Arbitration Rules and Procedures or the American Arbitration Association Commercial Arbitration Rules, depending on your location. The arbitration will take place in San Francisco, California, unless both parties agree to an alternative location. Claims must be brought individually, and consolidation or class action is not permitted unless both parties explicitly agree to it.

However, claims related to intellectual property rights infringement or unauthorized use or disclosure of confidential information may be brought before a court of competent jurisdiction. Such claims will be exclusively handled by the courts in San Francisco, California, and governed by California law.

Invalidity and Enforceability: If any provision of this Agreement is found to be invalid or unenforceable, that particular provision will be limited or eliminated in a manner that maintains its enforceability, while the rest of the Agreement will continue to be in full effect.

Amendments and Waivers:Any modifications or waivers to this Agreement must be documented in writing and agreed upon by both parties.

Non-Waiver: Our failure to enforce any obligation or right under this Agreement does not act as a waiver of our ability to enforce that obligation or any other provisions in the future.

This Agreement constitutes the entire understanding between you and Beauty AI concerning the Affiliate Program and does not alter or replace any other agreements you may hold with us.

Beauty AI retains the authority to modify the terms of this Agreement at any moment, which includes adjustments to the Commission rate. Any such changes will be effective immediately upon notification.
